Terms of Service

These Terms of Service govern your use of Scotoma, operated by Patryk Jarmakowicz (Eenmanszaak, KvK 84338512, Rotterdam, Netherlands). By using the service, you agree to these terms. If you disagree, please do not use the service.
1. Service Description
Scotoma is an assessment tool that helps individuals and teams understand their relationship with AI technology. The service includes:
- Free individual assessments: Available without an account - answer questions and receive your AI mindset profile
- Registered accounts: Optional sign-up (including via Google OAuth) to save and revisit results
- Paid team assessments: Team-wide assessments with aggregated dashboards, comparison tools, and team insights
Scotoma is designed for educational and informational purposes only. It is not professional consulting, psychological assessment, career counselling, or a substitute for expert advice in AI strategy or organisational development.
2. Account Responsibilities
Free tier: No account is required for individual assessments. Results are generated with a unique ID for later retrieval.
Registered accounts: If you create an account (directly or via Google OAuth), you are responsible for:
- Keeping your login credentials confidential
- All activity that occurs under your account
- Notifying us promptly if you suspect unauthorised access
Team organisers: If you purchase a team assessment, you are additionally responsible for distributing access links only to intended team members and ensuring participants are informed about data collection as described in our Privacy Policy.
3. Payment Terms
Team diagnostic pilots and workshops are paid services. All prices are listed in EUR unless otherwise stated. During the pilot phase, payments may be handled by invoice or another agreed payment method. By purchasing, you agree to pay all applicable fees and taxes.
Refund policy: We offer a 14-day money-back guarantee. If you are not satisfied, contact us at hello@scotoma.app within 14 days of purchase. Refunds are not available after the facilitated debrief or agreed deliverables have been delivered.
Prices may change. We will notify existing customers before applying price changes to any ongoing or renewed services.
4. No Guarantee of Accuracy
While Scotoma is based on academic research and designed to provide meaningful insights, we make no guarantee regarding the accuracy, completeness, or reliability of assessment results.
Results are indicative, not definitive. They represent patterns based on your responses at a specific point in time and should not be used as the sole basis for hiring, firing, promotion, or any other employment decisions.
5. Intellectual Property
The service and its original content, features, and functionality are owned by Scotoma and are protected by international copyright, trademark, and other intellectual property laws. This includes:
- The assessment framework and methodology
- All AI orientation profiles and their descriptions
- Visual designs, graphics, and user interface elements
- Software code and architecture
You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any part of the service without our express written permission.
Your results: You own your individual assessment results and may use them freely for personal or internal organisational purposes.
6. User-Generated Content and Research
By submitting assessment responses, you grant Scotoma a licence to use, store, and process this data to:
- Generate your assessment results
- Provide team dashboards and analytics
- Improve the assessment methodology
- Conduct academic research (in aggregated, anonymised form only)
Individual responses or personally identifiable information are never shared with third parties without your explicit consent. See our Privacy Policy for details on research data handling.
7. Prohibited Uses
You agree not to:
- Use the service for any unlawful purpose
- Attempt to reverse-engineer, decompile, or extract the assessment algorithm
- Scrape, mine, or harvest data using automated means
- Impersonate others or provide false information
- Interfere with or disrupt the service or its infrastructure
- Use results to discriminate against individuals in employment, housing, or other protected contexts
8. Limitation of Liability
To the maximum extent permitted by Dutch law, Scotoma shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from:
- Your use or inability to use the service
- Decisions made based on assessment results
- Unauthorised access to your data
- Errors, inaccuracies, or interruptions in the service
Our total liability for any claims under these terms shall not exceed the amount you paid for the service in the 12 months preceding the claim, or EUR 100, whichever is greater.
9. Termination
By you: You may stop using the service at any time. If you have a registered account, you may request account deletion by emailing support@scotoma.app. Your personal data will be removed in accordance with our Privacy Policy.
By us: We may suspend or terminate access to the service at our discretion if you violate these terms. In such cases, no refund is due for the remaining service period.
Refund on termination: If we discontinue the service entirely, customers with unused paid features will receive a pro-rata refund for the unused portion.
10. Age Requirement
You must be at least 16 years old to use the service. By using Scotoma, you confirm that you meet this age requirement.
11. Governing Law and Dispute Resolution
These terms are governed by the laws of the Netherlands. Any disputes arising from or relating to these terms or the service shall be submitted to the competent court in Rotterdam, Netherlands.
For EU consumers: you may also use the European Commission Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
12. Changes to These Terms
We may update these terms from time to time. Material changes will be communicated via email (for registered users and team customers) or by notice on the website.
Continued use of the service after changes become effective constitutes acceptance. If you do not agree to updated terms, you must stop using the service.

These Terms of Service are effective as of February 27, 2026. They constitute the entire agreement between you and Scotoma regarding the use of the service. If any provision is found to be unenforceable, the remaining provisions continue in full force and effect. See also our Privacy Policy.
